NOTICE OF ACTIVITY AND USE LIMITATION

A release of oil and/or hazardous materials has occurred at this location, which is a
disposal site as defined by M.G.L. Chapter 21E, Section 2, and the Massachusetts
Contingency Plan, 310 CMR 40.0000. On April 23, 2026, PMG Northeast LLC recorded
with the Northern Bristol County Registry of Deeds a Notice of Activity and Use
Limitation (AUL) on the disposal site, pursuant to 310 CMR 40.1070 through 40.1080.
The Notice of AUL will limit the following site activities and uses on a portion of the
disposal site:
ï‚· Activities and/or uses which are likely to involve the removal and/or disturbance
of the concrete pad and excavation associated with underground utility,
construction and/or other subsurface activities, with the exception of work
conducted in accordance with a Soil Management Plan and Health and Safety
Plan;
ï‚· Activities and/or uses which may cause physical or chemical deterioration,
breakage or structural damage to the concrete pad;
ï‚· Construction of any occupied building within the Portion of the Property, with the
exception of construction performed in accordance with Obligations and
Conditions.
